-예종이 재위 2년 만에 죽자 정희왕후는 후계자를 지명해야 했다. 이때 서열 1위는 종법의 순서대로 한다면 예종의 아들 제안대군이었다. 제안대군이 예종의 둘째 아들이기는 했지만, 첫째 아들 인성대군이 3살에 죽고 없었기 때문에 실질적으로 예종의 장남이었다. 그런데 이 제안대군은 당시 나이가 4살로 왕위에 오르기에는 너무 어린나이였다. 수렴청정을 한다고 해도 4살은 왕위계승이 어려웠다. 정희왕후는 제안대군을 제외시켰다. 그렇다면 그 다음 서열은 예종의 형 의경세자의 큰아들 월산대군이 된다. 월산대군은 이때 15살로 성숙한 나이였다. 그러나 정희왕후는 월산대군도 배제를 했다. 이는 명백히 종법의 서열에서는 벗어난 것이었다. 정희왕후는 이를 의식한 듯 월산대군이 건강이 좋지 않고 또 의경세자의 제사를 담당해야 한다는 등 세세한 이유를 들었다. 종법에서 벗어난 왕위계승이라는 문제제기를 의식한 탓으로 보인다.  .
